Terms of Service

1. Acceptance of Terms

Welcome to CalcBot. By accessing or using the website at https://calcbot.net (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, you must not access or use the Service.

These Terms form a legally binding agreement between you and CalcBot. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

CalcBot is a free, browser-based platform that provides:

• A catalog of 100+ online games across 12 categories (racing, sports, platformer, puzzle, action, adventure, .io, idle, horror, strategy, casual, and arcade).
• Optional free user accounts that track XP, levels, achievements, and play streaks.

The Service is provided free of charge. We may add, modify, or remove features or games at any time without prior notice. We may also introduce new free or paid features in the future; any paid features would be governed by additional terms presented at the time of purchase.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your country, e.g., 16 in most EU member states) to use the Service. If you wish to create an account, you represent that you meet this age requirement. If you are under 18, you also represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Service is not directed to children under 13. See our Privacy Policy Section 8 for our children's-privacy practices.

4. User Accounts

Most features of CalcBot do not require an account. If you choose to create a free account:

• You must provide accurate, current, and complete information at registration.
• You are responsible for safeguarding your password and for any activity conducted under your account.
• You agree to notify us immediately at contact@calcbot.net if you believe your account has been compromised.
• You may delete your account at any time by contacting us; we will erase your personal data within 30 days.
• We may suspend or terminate accounts that violate these Terms or that we believe are engaged in fraudulent, abusive, or unlawful activity.

5. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law.
• Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service (hacking, password mining, etc.).
• Interfere with or disrupt the Service, including by submitting viruses, overloading servers, scraping content at scale, automated crawling in violation of our robots.txt, or launching denial-of-service attacks.
• Use bots, scripts, or other automated means to interact with the Service in a way that mimics human behavior for the purpose of manipulating leaderboards, XP, or other gamification features.
• Submit content (through the contact form, account profile, or any other input) that is unlawful, defamatory, harassing, hateful, or that infringes the intellectual property or privacy rights of others.
• Frame, mirror, or redistribute any part of the Service without our prior written consent.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Service.
• Encourage or instruct any third party to do any of the above.

6. User-Generated Content

CalcBot has limited user-generated content. Specifically, if you create an account, you may choose a public display name and an "About me" text on your profile. You retain ownership of any content you submit. By submitting it, you grant CalcBot a non-exclusive, royalty-free, worldwide license to host, display, and reproduce that content on the Service for the purpose of operating your profile.

You represent that any content you submit does not infringe the rights of any third party and complies with applicable law. We reserve the right to remove or modify user content that we believe violates these Terms or is otherwise objectionable.

7. Third-Party Games & Embedded Content

The games available on CalcBot are not hosted on our servers. They are embedded in <iframe> elements that load the game directly from the original publisher's content delivery network. This means:

• When you play a game, your browser establishes a direct connection with the publisher's infrastructure, and that publisher's terms of service and privacy policy also apply to your use of the game.
• We do not control, and are not responsible for, the content, behavior, data collection, or availability of third-party games.
• We curate the catalog and remove games that we learn are no longer available, that violate our policies, or that are reported as infringing through a valid DMCA notice.
• If a game does not load, behaves unexpectedly, or is removed by its publisher, we have no obligation to provide a replacement.

8. Intellectual Property

8.1 CalcBot content

The CalcBot brand, logo, website design, layout, and original editorial content (game descriptions, how-to-play guides, tips, FAQ entries, and SEO text) are the property of CalcBot and are protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written consent, except for brief quotations for review or commentary purposes.

8.2 Game titles and trademarks

All game titles, character names, brand names, and trademarks appearing on CalcBot are the property of their respective owners. Their appearance on CalcBot is for identification and editorial purposes only, and does not imply endorsement by or affiliation with CalcBot. We respect intellectual-property rights and expect our users to do the same.

8.3 Editorial content

All how-to-play guides, tips, "About" descriptions, and FAQ entries on CalcBot are original editorial content written by our team. They may be quoted briefly with attribution and a link back to the relevant CalcBot page.

9. Advertising on CalcBot

The Service is supported by advertising, primarily through Google AdSense. By using the Service, you acknowledge that:

• Ads are delivered by Google and its partners, and Google's terms and privacy policy govern how ads are served.
• In regions where consent is required (EEA, UK, Switzerland), we will ask for your consent before serving non-essential advertising cookies.
• You can manage your ad settings through your Google account and through aboutads.info/choices.
• You agree not to click on ads on your own pages or to use automated means to generate invalid clicks or impressions. We actively monitor for invalid traffic and may block users or IP addresses engaged in such activity.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Service will be uninterrupted, error-free, secure, or available at any particular time.
• Warranties that the game descriptions, guides, or other content are accurate, complete, or reliable.
• Warranties regarding third-party games or the content of embedded iframes.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall CalcBot, its operators, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, goodwill, or other intangible losses.
• Damages resulting from your inability to use the Service.
• Damages resulting from the conduct or content of third parties, including third-party game publishers or advertisers.
• Damages resulting from any errors or inaccuracies in game descriptions or editorial content.

The total aggregate liability of CalcBot for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you have paid to CalcBot in the past 12 months, or (b) USD $10. Because the Service is provided free of charge, this limitation is reasonable and material to the basis of the bargain between the parties.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless CalcBot, its operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service in violation of these Terms.
• Your violation of any law or the rights of any third party.
• Any content you submit to the Service.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, without notice, if we believe you have violated these Terms or for any other reason at our discretion. We may also modify, discontinue, or shut down the Service at any time, without liability to you.

Upon termination, all licenses granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, indemnification, and governing law) will continue in effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws applicable at the place where the CalcBot server is hosted, without regard to its conflict-of-laws principles. You agree to submit to the personal jurisdiction of the courts located in that jurisdiction for any actions arising out of or relating to these Terms.

For EU consumers: nothing in these Terms affects your rights under mandatory consumer-protection laws in your country of residence.

15. Dispute Resolution

Before filing a formal dispute, we encourage you to contact us at contact@calcbot.net — many issues can be resolved informally within a few business days.

If informal resolution fails, any dispute will be resolved through binding arbitration rather than in court, except that you may bring a claim in small-claims court if it qualifies. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

16. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and updating the "Last updated" date. We will use reasonable efforts to notify you of material changes (for example, by displaying a notice on the homepage). Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
